By accessing our Site or contracting our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Site or utilize our services.
2. Services Description
MAV Homes LLC is a Kansas-based custom home builder dedicated to quality craftsmanship and integrity. Our services include, but are not limited to:
- Custom Home Design: Collaborative design services to create custom home plans tailored to client specifications.
- Blueprint Ready Plans: Provision of pre-designed, professional home plans ready for construction.
- Ground-Up Construction: Comprehensive management of the construction process from foundation to completion.
- Turnkey Solutions: Delivery of move-in-ready homes with complete finishing.
We strive to accurately describe and display our services and portfolio. However, we do not warrant that the descriptions, images, or other content on this Site are accurate, complete,
reliable, current, or error-free.
3. Client Responsibilities
Clients engaging MAV Homes LLC for construction services agree to:
- Provide accurate and complete information regarding property specifications, budget constraints, and design preferences.
- Secure necessary financing or proof of funds prior to the commencement of construction.
- Make timely decisions regarding materials, finishes, and design changes to avoid project delays.
- Ensure the building site is accessible for construction equipment and personnel.
- Obtain necessary permissions or variances unless explicitly included in our service agreement.
4. Project Timeline and Delays
We provide estimated timelines for project completion based on current schedules and availability. However, construction projects are subject to variables beyond our control, including but not limited to:
- Weather conditions impacting safe work environments.
- Supply chain disruptions or material shortages.
- Permitting delays from local government authorities.
- Unforeseen site conditions (e.g., soil issues, hidden obstructions).
MAV Homes LLC shall not be liable for delays caused by these external factors. We commit
to communicating any schedule adjustments promptly.
5. Payment Terms and Pricing
Pricing for custom home builds and construction services will be detailed in a separate Construction Agreement. General payment terms include:
- Deposits: A non-refundable deposit may be required to secure design services or a construction slot.
- Draw Schedule: Payments for construction projects are typically structured in “draws” based on project milestones (e.g., foundation pour, framing, dry-in).
- Invoices: All invoices are due upon receipt, unless otherwise specified in the Construction Agreement. Late payments may incur interest charges.
6. Changes to Plans and Change Orders
Any changes to the agreed-upon plans, materials, or scope of work must be documented in a written “Change Order.” Change Orders may result in adjustments to the contract price and project timeline. Work on Change Orders will commence only after the client has approved the updated cost and timeline in writing.
7. Warranties and Guarantees
MAV Homes LLC stands behind our craftsmanship. Our warranty coverage includes:
- Workmanship Warranty: We provide a warranty on workmanship and materials for a specified period, typically one (1) year from the date of substantial completion,
covering defects in construction. - Structural Warranty: We adhere to industry standards regarding structural integrity.
- Manufacturer Warranties: Appliances, equipment, and certain materials (e.g., shingles, windows) are covered by their respective manufacturers’ warranties. We will
assist in transferring these warranties to you upon closing.
This warranty does not cover normal wear and tear, damage caused by lack of maintenance, or modifications made by the homeowner or third parties after closing.
8. Limitation of Liability
To the fullest extent permitted by applicable law, MAV Homes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or
revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the
services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.
9. Intellectual Property
The content on the MAV Homes LLC website, including text, graphics, logos, images, and software, is the property of MAV Homes LLC or its content suppliers and is protected by
copyright and other intellectual property laws. Custom home designs and blueprints created by MAV Homes LLC remain our intellectual property unless ownership is explicitly transferred in writing.
10. Dispute Resolution
In the event of a dispute arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute informally through good-faith negotiation. If the dispute cannot be resolved informally, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any legal action or proceeding
relating to your access to, or use of, the Site or services shall be instituted in a state or federal court in Sedgwick County, Kansas.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms
taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree
to be bound by the revised terms.
